Enterprise Agreements.

Blackwood Springs has been assisting businesses put in place enterprise bargaining agreements, with both union and non-union involvement, for more than 10 years.

Enterprise Bargaining Agreements can be complicated depending on the level of complexity of the business concerned.  Enterprise agreements should aim to capture the terms and conditions applicable to a specific business replacing the need to be covered by an industrial award.
Sometimes this is not possible, particularly where a union is involved and where discussions between the parties involve both employee and employee representatives. 

There are strict procedural requirements regarding the making of enterprise agreements, however, it is just as important to ensure that a businesses’ employees are actively engaged in the process.

Conflict Resolution.

There are also occasions where conflicts arise in the day to day operation of a business.  It is important that conflict is handled properly to ensure that the issue does not escalate and the business finds itself having to defend a discrimination, harassment or bullying complaint in a legal jurisdiction. 
Where employment relationships break down to the extent where an employee may have to be dismissed it is critical that employers seek advice of the best way of handling the situation without ending up facing and unfair dismissal or adverse action claim in the Fair Work Commission or the Federal Court.

Consultation.

All businesses have compliance obligations in relation to consultation and communication with their people but good consultation and communication practice is also critical to good business performance.
Many employers don't have well-developed and attuned communication skills and can inadvertently send the wrong messages or expose themselves to risks of perceived non-compliance and misunderstandings which can be damaging commercially, to brand and to relationships.
